I have my EB2 485 pending (since July, 2007). I have EAD based on that filing. I am also on H1B - so I am not using EAD. But my wife intends to use EAD (based on our current EB2 based 485 filing) from coming August.
In the meanwhile I have got my EB1 140 approved. My question is if we file for 485 based on EB1 petition, do we lose our current EAD till a new EAD is issued under new filing? Are there ways to ensure that my wife continues with her employment and I move ahead with 485 filing?

Explore interfiling... no personal experience ... but the idea is that they use the same I-485 but interchange the underlying I-140. Seems like there is no special form for this but to just write to USCIS with evidence for the new approved EB1 I-140.

She plans to travel around last week of February. Is there a way to expedite processing of the AP document? Do I need to buy an airline ticket for her in advance to show the urgency of AP?

AP approvals are taking close to 3 months these days so you should e-file your application ASAP. Also, call USCIS at (800) 375 - 5283 to expedite your application once you have the receipt number since you need to travel at such a short notice.
Some people have had luck contacting their congress representative as well.

Maxim#39;s Hot 100 this year.Form AR-11 asks for the date my stay in the United States will expire. What date should I use? Currently, I am on working on EAD (I-485 pending) and last entered US on AP.
Note: Sorry for a duplicate thread. I posted my previous one in I-140 section. :confused:
IMO you should put the EAD expiry date. ( The fact is stay will never expire since it is a AOS pending).

However re-enters US only after 365 days of external stay in december 08 (not in Oct 08).
Is he eligible for a new 3X2 year H1 or can he obtain only a year extension to recapture the time spent abroad (365 days)?
You can get -
1. a year extension to recapture the time spent abroad
2. New/Extend H-1B for 3 year, but will be subject to cap
3. can get new/extension H-1B for 3 years without cap, if you have I-140 approved
4. can get new/extension H-1B for 1 year without cap, if I-140 is pending

Thanks, both of you. I got it yesterday, did a few test shots in a creek by my home and took a bunch of pics in the Black River this morning. In a fast riffle, there were some streaks from bubbles, but that didn't detract from the shot (subject was a smallmouth bass close up). In fact, I think it added the sense of current flow.
The Black is a very clear river, but it is not like the ocean. Looks like the closer the subject the better. I'm also learning how to process these images. I've been shooting for about 40 years, but this is a whole other world, and I'm on a learning curve. It's cool, though.

If you worry about the first petition, and you feel comfortable to do so, talk about it with the attorney of the second company. Or, you can call USCIS and ask a immigration officer.
I joined a new employer in May and also had applied for H1B transfer at that time. Now I have a very good offer from another firm but my first H1B transfer is still pending. The new offer is much more rewarding financially. Is it possible to apply for H1 B transfer to the new employer without jeopardizing my H1B status. Please note that I got laid off in April and I was in a hurry to get the new job then, it was also about just over a month when I applied for my H1B transfer since losing that job so I am kind of nervous about the results from USCIS.

Rosie Huntington WhiteleyYou do not require valid visa stamp to go India. If your kids are US citizen, you will need PIO card for them. While travelling back from India, you will be asked for valid Visa or AP to board fight for US from Frankfurt.
Our visa stamp (H1B/H4) are expired in our passports. We are planning to travel via 'Frankfurt (FRA), Germany' to Mumbai in Lufthansa airlines and we will get our passport .....................
I am doing same thing for about one month but don't know what is happening. I talked to one travel agent in Mumbai and he is asking for Rs 3500 to get Hindi appointmnet. I don't know if people again started any trick to book appointments..
